The Construction Training Fund (CTF) is committed to protecting the privacy of personal information it collects, holds, manages, uses, discloses and shares, in accordance with relevant legislation and policies, in performing its primary functions and delivering services.
The purpose of this statement is to clearly set out how the CTF collects, manages, uses and shares personal information to fulfil its functions and activities. The CTF follows the principles as defined in the Privacy and Responsible Sharing (PRIS) Act 2024 and PRIS Bill 2024 and supports the open, transparent and secure management of personal information.
Collection of personal information
The CTF collects the personal information of individuals necessary to carry out its core functions and activities. The primary purposes and functions for collecting personal information include:
- Compliance with the Building and Construction Industry Training Fund and Levy Collection Act 1990
- Collection and administration of the Building and Construction Industry Training Fund Levy
- Administration and disbursement of grants and subsidies
- Determination of eligibility for relevant grants, subsidies and payments
- Communication and engagement with stakeholder groups, including construction project owners, employers, workers, apprentices, trainees, students and parents
- Providing information relating to the CTF’s programs
- Supporting the safety and wellbeing of the workforce in the building and construction industry
- Informing policy and strategy
- Research or statistical purposes
- Recruitment and employment
- Procurement of contractors and service providers
- Legal, regulatory and/or reporting processes and obligations
The CTF will collect and use a broad range of personal information, which may include the following:
- Name, gender, date of birth, racial or ethnic origin
- Contact details (address, email, phone number)
- Guardian details (if under 18)
- Personal circumstances, such as occupation and pay slips
- Photographs, audio and/or visual recordings, CCTV footage
- Training history and VET qualifications
- Employment status and history
- Working with children checks and criminal screening
- Financial information, such as bank details
- Government identifiers, such as training contract identification number, builder’s registration number
The CTF may collect personal information through the following means and/or for the following circumstances:
- Administration of CTF programs
- Communications
- Disbursement of funds
- Campaigns and initiatives
- Complaints and inquiries
- Audits
- Compliance
- Investigations
- Contract agreements
- Website
- Human resource management
- Research
- As required by law
The CTF will take all reasonable steps to ensure that personal information collected, used or disclosed is accurate, complete, up to date and relevant.
Use and disclosure of personal information
Personal information collected by the CTF will be used, disclosed or shared for the primary purpose it is collected, including as follows:
- for a primary purpose (as defined above)
- for a related secondary purpose where one of the following applies:
- it is reasonable for it to be expected in line with the primary purpose
- with consent of an individual or parent and/or legal guardian
- when the CTF is seeking to provide information about or promote its services
- when the CTF reasonably believes it is necessary to prevent or lessen a serious threat to the health, safety or welfare of any individual, public health, public safety or public welfare or a threat to any individual due to family violence
- when required or authorised by law
- to investigate or report suspected unlawful activity, or when reasonably necessary for a specified law enforcement purpose, including the prevention or investigation of a criminal offence or seriously improper conduct, by or on behalf of a law enforcement agency
- as de-identified information, for research or statistics purposes, or to inform the CTF’s and/or government policy and strategy
- to establish or respond to a legal claim
Protection of personal information
The CTF will take all reasonable steps to protect information from misuse, loss, unauthorised access, modification and disclosure. Management of electronic and paper records is consistent with the CTF’s Records Management Policy and procedures. Unless it is unlawful to do so, when personal information is no longer required it is destroyed or permanently de-identified, in compliance with the CTF’s Retention and Disposal schedule.
Access to, correction or deletion of personal information
All individuals, or their authorised representatives, have a right to request access to the personal information that the CTF holds about them, or to request correction of this information, or deletion, if it is lawful to do so.
The CTF will not delete personal information if it is unlawful to do so. Lawful deletion of personal information at the request of an individual will result in the CTF’s inability to continue to provide services that the individual may otherwise be eligible to receive.
Requests for access to personal information, or to correct this information should be emailed to info@ctf.wa.gov.au and include “privacy concerns” in the subject line. Individuals can also make a complaint to CTF about how the CTF manages their personal information. Please refer to the CTF’s complaints management policy for further information.
The CTF will manage the prevention, containment, remediation and investigation when a breach of information occurs in line with its Information Breach Policy and procedures.
Automated decision-making
Where the CTF engages in an automated decision-making process that involves the personal information of an individual, an assessment will be conducted in line with the relevant legislation and the CTF’s values, policies and procedures.
Complaints and breach of privacy
Complaints specifically about the CTF’s handling of personal information are managed in line with the CTF’s Complaints Policy.
The CTF website
The CTF Privacy and Responsible Information Sharing Guide applies to the CTF website (www.ctf.wa.gov.au) but does not apply when following a link from its website to another site.
Collection of personal information via the ctf.wa.gov.au website
No personal information is collected when browsing the CTF website; however, the following user information may be automatically recorded by the site’s web server for statistical and system administration purposes only:
- server address
- top level domain name (e.g. .com, .au, .gov)
- The date and the time of visit to the site
- pages accessed and downloaded
- address of the last site visited
- device type
- operating system
- browser
The CTF will not attempt to identify individuals from the above information unless it is necessary to investigate a breach of law or regulation.
Cookies
The CTF website uses cookies. A cookie is a block of data that is shared between a web server and a user’s browser. Cookies, and the information collected through them, are used by www.ctf.wa.gov.au to make this website more efficient.
The CTF Portal
The CTF portal is designed to facilitate secure transactions with the CTF and requires the collection of personal information. This personal information is stored in a secure database and enables the CTF to exchange communications with users.
The portal provides secure access to a user’s personal information and transactions with the CTF, which may include levy payments and/or program claims.
It is a portal user’s responsibility to
- Keep log-in details secure and not share these details with another person
- Ensure personal information (e.g. name, contact details) are correct and up-to-date
If a user is an administrator for a company account with multiple users, the administrator is responsible for
- Maintaining correct contact details of the users listed on the CTF account
- Terminating access rights for non-current users
The CTF may suspend or terminate a portal user’s account if a breach is identified and, in some instances, the user could face civil or criminal penalties.
Construction Futures Centre
When a user registers for a session in the Construction Futures Centre, the CTF collects personal information such as name, contact details, postal address, email and phone number. Other information may be required if it is relevant.
The data the CTF collects is used to:
- Administer and manage the Construction Futures Centre experience
- Understand more about the composition, needs and behaviours of the CTF’s visitors
- Provide personalised and relevant content
- Perform research and analysis aimed at improving content and services; and
- Provide information on upcoming Construction Futures Centre services and events that may be of interest.
